Terms of Service

The ground rules for using Promall. Please read them carefully before creating an account or using our services.

These Terms of Service ("Terms") govern your access to and use of the Promall platform, websites, APIs, and related services (the "Services") operated by PROMAL LABORATORIES ("Promall", "we", "us"). By creating an account or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Services.

1. Acceptance of Terms

  • By accessing or using Promall in any way — including signing up, browsing, integrating a social channel, or running an automated assistant — you agree to these Terms.
  • If you use the Services on behalf of a business, you represent that you are authorized to bind that business, and "you" refers to both you and that business.
  • We may update these Terms from time to time. Material changes will be communicated by posting the updated Terms on this page and revising the "Last Updated" date. Continued use after changes means you accept the updated Terms.
  • If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full effect.

2. Accounts & Eligibility

  • You must be at least 18 years old (or the legal age of majority where you reside) to create a Promall account.
  • You agree to provide accurate, current, and complete information during registration and to keep it up to date.
  • You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us immediately at security@promall.io if you suspect unauthorized access.
  • One person or legal entity may not maintain more than one free account. We may suspend duplicate accounts at our discretion.
  • You are responsible for ensuring that anyone who accesses the Services through your account complies with these Terms.

3. Acceptable Use

  • You will not use Promall to send spam, unsolicited bulk messages, deceptive content, or any communication that violates applicable anti-spam or consumer-protection laws.
  • You will not use the Services to sell, promote, or distribute illegal goods, counterfeit items, controlled substances, weapons, sexually explicit content, or any content that infringes intellectual-property rights.
  • You will not attempt to reverse-engineer, decompile, scrape at scale, probe for vulnerabilities, or otherwise interfere with the security or integrity of the Services.
  • You will not impersonate any person, misrepresent your affiliation, or use Promall to harass, threaten, or harm others.
  • You will not use the Services to train competing machine-learning models or to systematically extract data for resale.
  • You will comply with all applicable laws and regulations, including data-protection, export-control, and tax laws.

4. Subscriptions & Payments

  • Some features of Promall are offered on a paid subscription basis. Pricing, billing cycle, and included usage are presented at checkout and may be updated with reasonable notice.
  • All fees are charged in advance and are non-refundable except where required by law. You authorize us to charge your chosen payment method on each renewal until you cancel.
  • You can cancel a paid plan at any time from your account settings. Cancellation takes effect at the end of the current billing period; the Services remain available until then.
  • If a payment fails or is reversed, we may suspend paid features until the balance is resolved. Persistent non-payment may result in account termination.
  • We are not responsible for fees charged by your bank, card issuer, or payment provider.

5. Intellectual Property

  • Promall, including its software, design, branding, and documentation, is owned by PROMAL LABORATORIES and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms.
  • You retain all rights to the content you upload (products, images, messages, customer data). By uploading content, you grant us a worldwide, royalty-free license to host, process, transmit, and display that content solely to provide the Services to you.
  • You represent that you have all rights necessary to upload your content and that it does not infringe any third-party rights.
  • Any feedback or suggestions you provide may be used by us without obligation or compensation.
  • Trademarks, logos, and service marks displayed on the Services are the property of Promall or their respective owners and may not be used without prior written permission.

6. Third-Party Integrations (Meta, Instagram, and Others)

  • Promall lets you connect third-party services such as Meta (Facebook, Instagram), payment processors, shipping carriers, and analytics providers. Your use of those services is governed by their own terms and privacy policies, including the Meta Platform Terms and Instagram API Terms where applicable.
  • When you connect a Meta-owned account, you authorize Promall to access, store, and process the data you have explicitly granted via the Meta permissions screen — solely to deliver the features you have requested (for example, replying to direct messages or syncing comments).
  • You are responsible for ensuring that you have the legal right to connect any third-party account and to share that account's data with Promall.
  • Promall is not responsible for the availability, accuracy, or behavior of third-party services. If a third-party service changes or removes an API, the related feature may be limited or removed without liability to you.
  • You may disconnect any third-party integration at any time from your account settings. Upon disconnection we will stop pulling new data from that service; previously synchronized data is handled in accordance with our Privacy Policy and your deletion requests.

7. Suspension & Termination

  • You may stop using Promall and delete your account at any time from your account settings or by contacting support@promall.io.
  • We may suspend or terminate your access immediately, without prior notice, if you breach these Terms, create risk or legal exposure for Promall, or use the Services in a way that could harm other users or third parties.
  • Upon termination, your right to use the Services ends. We will retain or delete your data in accordance with our Privacy Policy and applicable legal-retention requirements.
  • Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.

8. Disclaimers & Limitation of Liability

  • The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not warrant that the Services will be uninterrupted, error-free, secure, or free from viruses or other harmful components. You are responsible for backing up critical data.
  • To the maximum extent permitted by law, Promall and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Services.
  • Our total aggregate liability for any claim arising out of these Terms will not exceed the greater of (a) the fees you paid us in the twelve months preceding the event giving rise to the claim, or (b) one hundred US dollars (USD 100).
  • You agree to indemnify and hold Promall harmless from any claims arising out of your content, your use of the Services, or your breach of these Terms.
  • These Terms are governed by the laws applicable to PROMAL LABORATORIES's place of incorporation, without regard to its conflict-of-laws rules.
